Woman suing Silver Lake Mall

A Coeur d’Alene woman is suing the Silver Lake Mall for injuries she says she suffered after allegedly slipping on a wet floor last year while walking in the food court.

Linda Frederick filed a suit for more than $10,000, alleging mall owners, managers and a contracted janitorial service were negligent by leaving a floor wet and slippery without putting up warning signs.

According to the lawsuit filed this week in First District Court, Frederick suffered a torn hamstring tendon after slipping on the floor around 8:30 p.m., May 13, 2016, while walking toward the restrooms located in the food court.

Frederick was in the mall for a music event and was on her way to the bathroom when “suddenly and without warning (her) right foot slid forward and her left foot slid behind her, causing (Frederick) to do the splits,” according to the lawsuit. “(Frederick’s) pubic bone slammed on the ground and made a sound loud enough for other mall patrons to hear.”

While she lay on the ground, she noticed the floor was wet and she was “in fact lying in a puddle of water.”

No signs warned pedestrians of the wet floor, according to the lawsuit, and Frederick was transported to the hospital where she underwent emergency medical care.

Silver Lake Mall LLC, which owns the mall, is named in the lawsuit, as well as Millard Mall Services, Inc. which provides janitorial services at the mall.

The suit alleges the defendants failed to keep the premises safe, failing to warn of hazards in the mall and for exposing the plaintiff to unreasonable risks.

Although the suit does not specify the dollar amount of damages it seeks, Frederick, though her attorneys, James, Vernon and Weeks, of Coeur d’Alene, is seeking compensation for medical expenses pain, suffering, the loss of enjoyment of life, lost wages and attorney fees.
