Judge denies request to reduce bail from $750K
COEUR d'ALENE -- County prosecutors revealed Thursday they have a videotape of the accident that killed a 10-year-old boy and put a Cocolalla man in Kootenai County jail for related charges.
Ryan Jabaay, 32, waived his preliminary hearing and his attorneys argued for a lowered bond in district court.
Kootenai County Chief Deputy Prosecutor Marty Raap said Jabaay was more of a flight risk than ever since Judge Jim Stow set his bond at $750,000 on May 27.
"Not only has nothing changed for him, but things have gotten much worse," Raap said. "We found a videotape of the accident occurring and, from our perspective, it confirms that he is at fault."
Raap said the results of a blood alcohol test have also been determined since Jabaay's bond was first set and he had a blood alcohol level of .30 when he was arrested.
"A normal person wouldn't be functioning at that level," Raap said.
Judge Barry Watson seemingly agreed with the prosecutor, leaving Jabaay's bond at $750,000.
Jabaay has been charged with vehicular manslaughter, two counts of aggravated driving under the influence and one count of leaving the scene of an accident. Leaving the scene of an accident carries a two-and-a-half year maximum sentence and the other three felonies have a 15-year maximum.
On May 26, witnesses said Kaye Frisbie was southbound in a 1990 Mazda 323 on Fourth Street in the eastbound turn lane for Interstate 90 at 9:47 p.m. Monday when Jabaay allegedly ran a red light traveling northbound at a high rate of speed. His 2006 Ford F-150 struck the passenger side door of the Mazda, causing massive damage. The Coeur d'Alene Fire Department removed the victims from the vehicle.
Kaye Frisbie suffered head injuries, 12-year-old Christian Frisbie had injuries to his legs and pelvis and 10-year-old Sawyer Frisbie was killed on impact. When officers arrived at the scene, Jabaay allegedly tried to run from the area and was pursued by a Coeur d'Alene police officer.
Jabaay's record includes two felony criminal mischief charges, driving under the influence, misdemeanor possession of marijuana and minor in possession of alcohol.
